1. Eligibility:
Nissan Keep Summer Rolling Instant Win and Sweepstakes (collectively, the "Promotion") is open only to legal residents of the fifty (50) United States and the District of Columbia ("U.S.") who are at least eighteen (18) years old at the time of entry and who, as of August 1, 2011, own a Nissan automobile and have a valid driver's license. Void where prohibited. Employees, directors, officers, agents, franchise owners or representatives of Nissan North America, Inc., The Marketing Store Worldwide, LLC ("Promotion Administrator"), and their respective related companies, affiliates and agents, prize suppliers, and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children), wherever they may live, and same household members of each such employee/director/officer/agent/franchise owner/representative (whether related or not) are not eligible to participate.
2. Agreement to Official Rules:
By participating in the Promotion, each eligible entrant ("Entrant") fully and unconditionally agrees to and accepts these Official Rules and the decisions of Promotion Administrator, which are final and binding in all matters related to the Promotion.
3. Timing:
The Promotion begins on August 1, 2011 at 12:00:01 a.m. Eastern Time ("ET") and ends on 11:59:59 p.m. ET, October 31, 2011 (the "Promotion Period").
4. HOW TO PARTICIPATE:
The Promotion consists of an Online Instant Win and Weekly Instant Win ("Online Play") for the chance to win vehicle maintenance service plan prizes or 50 Points in the Nissan "One To One" Rewards Program (or, a $50 Gift Card) (see Rule 9A & 9B) and a Sweepstakes Random Drawing ("Sweepstakes Entry") for the chance to win your choice of one (1) from a selection of four (4) 2012 Nissan automobiles (see Rule 9C). Participation requires a PIN Code (the "PIN") found on the advertising piece sent to you in the mail. (If you did not receive an advertising piece or if the PIN on your advertising piece is illegible, irregular, incomplete, destroyed, lost or otherwise cannot be used, you can enter by using your vehicle identification number ["VIN"].) The entry form will ask whether you wish to receive e-mails regarding future Nissan promotions. Whether you participate as outlined in 4A or 4B, you are NOT required to "opt-in" to receive such e-mails in order to participate in the Promotion and your decision whether (or not) to do so will not affect your chances of winning.
- A. To Participate With Service:
Go to any participating Nissan dealership in the U.S. between August 1, 2011 and September 30, 2011 to have your vehicle serviced (can be any type of service on your vehicle), then go to www.keepsummerrolling.com during the Promotion Period and enter the unique PIN and then select "Go" to prepopulate on the entry form your information (VIN, first and last name, street address including city, state and ZIP, e-mail address, telephone number [including area code]). Review your information and correct/edit it as necessary. IT IS THE ENTRANT'S SOLE RESPONSIBILITY TO CONFIRM THE ACCURACY OF THIS INFORMATION. Create and confirm a password and then enter your current odometer reading as of date of registration. You will receive one (1) entry into the Sweepstakes Drawing and one (1) online play in the Instant Win for a chance to win an Instant Win Prize and/or a Weekly Instant Win Prize. - B. NO PURCHASE NECESSARY. To enter without purchase/vehicle service:
Go to www.keepsummerrolling.com during the Promotion Period and complete the entry form with VIN, first and last name, street address including city, state and ZIP, e-mail address, and telephone number (including area code) and the current odometer reading as of date of entry. LEAVE THE REPAIR ORDER NUMBER FIELD BLANK AS THIS IS NOT REQUIRED FOR ENTRY. Submit your entry. You will receive one (1) entry into the Sweepstakes Drawing and one (1) play in the Instant Win Game for a chance to win an Instant Win Prize and/or a Weekly Instant Win Prize. All Online Plays and Sweepstakes Entries must be received during the Promotion Period (and, as discussed in Rule 7 below, Online Plays must be received during the Selected Day (as defined below) of a given week of the Promotion Period). Limit of one (1) Sweepstakes Entry/Online Play per Eligible Participant/e-mail address/vehicle identification number VIN/PIN per day. PIN may be used only by the person to whom it was provided by Sponsor; VIN may only be used by the owner of the applicable vehicle. PINs and VINs cannot be transferred, purchased, sold or exchanged and cannot be redeemed for cash or credit. Improper use of PIN or VIN may result in disqualification. Proof of submission of entry does NOT constitute proof of receipt. Multiple entrants are not permitted to share the same e-mail address. Any attempt by any entrant to obtain more than the stated number of entries/Online Plays by using multiple/different e-mail addresses, identities, registrations and logins, or any other methods will void that entrant's entries/Online Plays and that entrant will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to ownership of any entry/Online Play, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
5. Instant Win.
During the Promotion Period, winning times (each a "Winning Time") will be randomly pre-selected by the Promotion Administrator. The first Entrant whose Online Play is received at or after a Winning Time will win an Instant Win Prize, subject to verification. Limit one Instant Win/Weekly Instant Win Prize per household/address.
6. Sweepstakes Random Drawing:
Promotion Administrator will conduct the Sweepstakes Drawing on or about November 15, 2011. The three (3) Entrants initially selected as potential winners will be notified by Sponsor or Promotion Administrator via phone, mail or e-mail within six (6) business days of selection. Limit one Sweepstakes Drawing Prize per household/address.
7. Weekly Instant Win Prizes:
Each week beginning on August 1, 2011 at 12:00:01 a.m. ET on Monday and ending at 11:59:59 p.m. ET on the following Sunday★★(a "Week") for a total of thirteen (13) weeks, there will be seven or eight prizes seeded on one day during that Week. The specific day in each Week will be randomly determined ("Selected Day"). Each Selected Day will have seven (7) or eight (8) prizes of a two (2) year Silver Maintenance Package available to be won at randomly selected Winning Times on that Selected Day. The first Entrant whose Online Play is received at or after a Winning Time on a Selected Day will win a Weekly Instant Win Prize, subject to verification. Limit one Weekly Instant Win Prize per household/address. For the avoidance of doubt, Weekly Instant Win Prizes will not be available to be won on any day of a Week other than the Selected Day. ★★ (Except for the 13th Week, which begins on Monday, October 24, 2011 but ends on Monday, October 31, 2011).
8. Verification of Winners:
All selected potential winners must comply with these Official Rules. Sweepstakes Drawing Prize winners must sign and return to Promotion Administrator, within ten (10) days of the date of notification, an Affidavit of Eligibility, Liability and Publicity Release (where lawful) ("Affidavit"). Sponsor/Promotion Administrator reserve the right, at their sole discretion, to condition award of Instant Win Prize or Weekly Instant Win Prize on potential winner establishing to Sponsor's/Promotion Administrator's satisfaction that he/she participated in the Promotion in compliance with these Official Rules and obtained the PIN (and, if applicable, Repair Order Number) through authorized, legitimate channels. If potential winner of any prize cannot be contacted, fails to sign and return the Affidavit within the required time period (if applicable), or any prize is returned as undeliverable, such potential winner will be disqualified and forfeit the prize without compensation of any kind. A potential winner must claim his/her prize in the timeframe identified in the Affidavit or forfeit the prize. The deadline for any potential winner to call the prize claim number is December 15, 2011 at 5:00:00 p.m. ET and all completed Affidavits must be received by the claim center no later than December 31, 2011. If a Grand Prize is forfeited, an alternate potential winner will be selected from among all remaining eligible entries received for the Sweepstakes Drawing. IF ANY INSTANT WIN PRIZE OR ANY WEEKLY INSTANT WIN PRIZE IS FORFEITED OR UNCLAIMED FOR ANY REASON, IT WILL NOT BE AWARDED.
9. PRIZES:
A. INSTANT WIN PRIZES: Three Hundred (300) Prizes: a one-year Nissan Maintenance+Plus® Bronze Maintenance Package, ARV: $200; Two Hundred (200): 50 points in the Nissan "One To One Rewards" Program (subject to Terms & Conditions of Nissan "One To One" Rewards Program) or a $50 Gift Card (subject to terms/conditions indicated thereon; Sponsor to select issuer of Gift Card in its sole discretion), ARV: $50. Odds of winning an Instant Win Prize will depend on the number of entries/Online Plays and when during the Promotion Period that an individual enters (and submits an Online Play). B. WEEKLY INSTANT WIN PRIZES: One Hundred (100) Prizes: a two-year Nissan Maintenance+Plus Bronze® Maintenance Package, ARV: $400. Odds of winning a Weekly Instant Win Prize will depend on the number of entries/Online Plays on the day such prizes have been seeded (i.e., the Selected Day) and when during a given week of the Promotion Period that an individual enters (and submits an Online Play). C. SWEEPSTAKES PRIZES: Three Grand (3) Prizes: Winner's selection of ONE of the following: a 2012 Nissan Murano SL crossover sport utility vehicle with floor mats or a 2012 Nissan Maxima sedan with the sport package, monitor package and floor mats, or a 2012 Nissan Z Coupe automatic with the sport package, back-up camera, and floor mats or a 2012 Nissan Quest SL minivan with the DVD entertainment center and floor mats, ARV: $37,400; PLUS a two-year Nissan Maintenance+Plus® Bronze Maintenance Package, ARV $400 TOTAL ARV: $37,800. Odds of winning a Sweepstakes Prize depend on the total number of eligible entries received during the Promotion Period.
10. Additional Prize Information, Terms & Conditions:
Grand Prize vehicle: Subject to availability in terms of model, color and features at the time of prize award. Grand Prize Winner will be required to provide valid driver's license and proof of insurance at time of delivery. Sponsor is not responsible for delays in delivery. Grand Prize vehicle described herein does not include, and Grand Prize Winner is solely responsible for, title, license, registration, dealer preparation costs, auto insurance, upgrades/options not included on vehicle and other third-party fees associated with acceptance and use of the prize. Grand Prize Winner must take delivery of prize from the automobile dealership designated by Sponsor and must take possession of prize within sixty (60) days of notice by Sponsor that prize is available. One-year Nissan Maintenance+Plus® Bronze Maintenance Package: is for basic levels of preventative vehicle maintenance and consists of four (4) oil filter changes and two (2) wheel tire rotations (excluding 350Z and 370Z models) for twelve (12) months or 15,000 miles whichever occurs first; maintenance offered once every three (3) months during covered twelve (12) month period or every 3,750 miles whichever occurs first. Two year Nissan Maintenance+Plus® Bronze Maintenance Package: is for basic levels of preventative vehicle maintenance and consists of eight (8) oil filter changes and four (4) wheel tire rotations (excluding 350Z and 370Z models) for twenty four (24) months or 30,000 miles whichever occurs first; maintenance offered once every three (3) months during covered twelve (12) month period or every 3,750 miles whichever occurs first. Coverage begins at the mileage provided by winner during prize notification and on the date plan is processed by Sponsor; and, no refunds will be given for scheduled maintenance not performed at the prescribed intervals or for maintenance services that do not apply to that particular vehicle. Winners will receive their service plan paper work within 45 days of their plan being activated on their vehicle. NOTE: If a winner already owns GT-R model or has a service plan, prize consists of a credit of comparable value toward vehicle service plan or $200 credit for maintenance service at any participating dealership. NOTE: If a winner already has Nissan Maintenance Service Plan, he/she will instead receive a Dealer Service Card valued at $200 for the one year service plan and $400 for the two year maintenance plan; Dealer Service Card is subject to terms/conditions indicated thereon. To receive prize(s), Sponsor must be able to verify potential winner's ownership of Nissan vehicle and authenticity of the vehicle identification number (VIN) of such vehicle; if vehicle has been the subject of a "salvage" or similar title under any state's law, or "Totaled" by a licensed insurance company; that is, been the subject of any insurance company's cash payment of claim in lieu of repairs because of a determination that the cost of repairs exceeded the actual cash value of the vehicle; any vehicle not distributed by Nissan, vehicle identification number (VIN) is not valid, potential winner will be disqualified and the prize(s) forfeited. All winners are solely responsible for all taxes, including, but not limited to, federal, state, local and income taxes and other fees and expenses associated with acceptance of prize(s) which are not specified herein and may be required to furnish appropriate tax documentation. No substitution, assignment or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute a prize/prize component with another prize/prize component of greater or equal value due to prize unavailability for any reason. Prizes are not exchangeable or redeemable for cash (the preceding excludes $50 Gift Card prize where such exchange/redemption for cash is required by law). Limit: One (1) Instant Win Prize or one (1) Weekly Instant Win Prize and one (1) Sweepstakes Prize per person/e-mail address/vehicle identification number VIN/PIN.
11. Publicity:
Except where prohibited, acceptance of prize(s) constitutes winner's consent to Sponsor's use of winner's name, likeness, voice, biographical information and other indicia of persona for promotional/trade/publicity purposes in any media, without further notice, payment or consideration.
12. General Conditions:
Sponsor reserves the right to suspend, cancel or modify the Promotion if fraud, technical failures or any other factor beyond Sponsor's control impairs the integrity of the Promotion such that it cannot be conducted as originally planned, as determined by Sponsor in its sole discretion. In such event, Sponsor will make the prizes available to be won in a manner determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted on www.keepsummerrolling.com. No more than the stated number of prizes will be awarded. In the event that production, seeding, printing, digital or programming failures, or other reasons or errors cause more than 500 Instant Win Prizes (i.e., 300 one-year Nissan Maintenance Package Prizes and/or 200 Nissan "One To One" Reward Points/$50 Gift Card Prizes) and/or 100 Weekly Instant Win Prizes (i.e., 7 or 8 Weekly Instant Win Prizes per week of the Promotion Period) to be available and/or claimed during the Promotion Period (or on Selected Day(s)/weeks of the Promotion Period, as applicable), Sponsor reserves the right to award only the Instant Win Prizes previously not awarded (up to a total of 500 Instant Win Prizes) or, as applicable, only the Weekly Instant Win Prizes previously not awarded for a given week (up to a total of 7 or 8 Weekly Instant Win Prizes per week), by means of a random drawing among all legitimate eligible Instant Win Prize claimants or eligible Weekly Instant Win Prize claimants for each affected week, as applicable. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process, Online Play process or the operation of the Promotion or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Promotion is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and costs (including without limitation attorneys' fees) from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
13. Release:
By receipt of prize(s), winner agrees to release and hold harmless, Nissan North America, Inc., The Marketing Store Worldwide, LLC. and each of their related companies, respective officers, directors, members, employees, and agents ("Released Parties") from and against any claim or cause of action arising out of participation or attempt to participate in the Promotion or acceptance, possession, receipt or use/misuse of prize(s). Nissan vehicles are subject only to the express, written limited warranties provided by Nissan North America, Inc. as specifically set forth in the Warranty Booklet of the vehicle. Services provided in conjunction with the one-year Nissan Maintenance Package and two-year Nissan Maintenance Vehicle Service Plan are subject only to the applicable express, written limited warranties provided by Nissan North America, Inc., as specifically set forth in such warranty materials. All such warranties shall only run for the indicated term and are subject to all other conditions indicated therein. SPONSOR MAKES NO OTHER WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO PRIZES, INCLUDING WITHOUT LIMITATION THEIR QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
14. Limitations of Liability:
Released Parties are not responsible for and entrants release and hold the Released Parties harmless for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process, Online Play process or the Promotion; (iv) electronic or human error which may occur in the administration of the Promotion or the processing of entries and/or Online plays; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which injury or damage may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion.
15. Disputes:
Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action, and by the United States District Court for the Middle District of Tennessee or the Tennessee State Court located in Williamson County, Tennessee and by participating, entrant expressly consents to the personal jurisdiction of such courts and waives any right of change of venue or like right; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Tennessee, without giving effect to any choice of law or conflict of law rules (whether of the State of Tennessee or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Tennessee.
16. Privacy:
Entrant's Personal Information: Information collected from entrants is subject to Sponsor's Privacy Policy (available at www.keepsummerrolling.com/privacy.html) and the Privacy Policy of Promotion Administrator.
